Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your use of Better Execute ("Service") operated by Better Execute Pty Ltd ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into these Terms. By using the Service, you represent that you meet these requirements.

3. Account and Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

4. Acceptable Use

You agree not to: (a) violate any applicable laws; (b) infringe on others' intellectual property; (c) transmit malware or harmful code; (d) attempt to gain unauthorised access to the Service or others' accounts; (e) use the Service for any illegal or unauthorised purpose.

5. Subscription and Payment

Better Execute is offered in three subscription tiers, billed per user per month:

Subscriptions are billed monthly in advance. You authorise us to charge the payment method on file. Price changes will be notified at least 30 days before they take effect.

5.3 Refunds

We offer a 30-day money-back guarantee for your first subscription. If you cancel within 30 days of your initial purchase and request a refund, we will refund the amount paid for that first billing period.

After the first 30 days, fees are non-refundable. No refunds or credits for partial months, unused user seats, or downgrades. If you cancel, you retain access until the end of your current billing period.

We may issue refunds at our discretion in exceptional circumstances (e.g. duplicate charges, service failures). Refunds required by applicable law will be honoured.

6. Intellectual Property

The Service and its content, features, and functionality are owned by Better Execute Pty Ltd and are protected by copyright, trademark, and other laws. You retain ownership of data you submit; you grant us a licence to use it to provide the Service.

7. Data and Privacy

Our collection and use of personal data is described in our Privacy Policy. By using the Service, you consent to such collection and use.

8. Termination

We may suspend or terminate your access for breach of these Terms. You may terminate your account at any time. Upon termination, your right to use the Service ceases immediately.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TO THE EXTENT PERMITTED BY AUSTRALIAN CONSUMER LAW, ANY IMPLIED WARRANTIES NOT EXCLUDABLE BY LAW ARE LIMITED TO 30 DAYS.

10. Limitation of Liability

To the maximum extent permitted by law, our total liability to you for any claim arising from or related to these Terms or the Service shall not exceed the total amount you paid us in the 12 months preceding the claim. In no event shall we be liable for indirect, incidental, special, consequential, or punitive damages.

Nothing in these Terms excludes or limits rights you may have under the Australian Consumer Law that cannot be excluded or limited.

11. Governing Law

These Terms are governed by the laws of Queensland, Australia. Disputes shall be resolved in the courts of Queensland, Australia, and you submit to the non-exclusive jurisdiction of those courts.

12. Changes

We may modify these Terms. We will notify you of material changes via email or in-app notice. Continued use after changes constitutes acceptance.
